§ 1. GENERAL PROVISIONS
These Terms and Conditions set out the general terms, method of sale, and rules for making transactions in the online store available at WWW.PAT-SEGE.COM. The Store is operated by Patrycja Segedyn, conducting business under the name PAT SEGE.
§ 2. DEFINITIONS USED IN THESE TERMS AND CONDITIONS
TERMS AND CONDITIONS means these Terms and Conditions.
SELLER means Patrycja Segedyn, conducting business under the name PAT SEGE, with its registered office at: 59-800 Lubań, ul. Górnicza 1a, Poland, Tax Identification Number (NIP): 8982303969, REGON: 527752611.
CUSTOMER means an entity to whom electronic services may be provided in accordance with these Terms and Conditions and applicable law, or with whom a Sales Agreement may be concluded.
CONSUMER means a natural person performing a legal act with an entrepreneur, which is not directly related to that person’s business or professional activity.
ENTREPRENEUR means a natural person, legal person, or organizational unit that is not a legal person but has legal capacity under the law, conducting business or professional activity in its own name and performing a legal act directly related to its business or professional activity.
STORE means the online store operated by the Seller at WWW.PAT-SEGE.COM.
PRODUCT or PRODUCTS means goods offered by the Seller for retail sale in the Store.
PRICE means the monetary value the Customer is obliged to pay to the Seller for the Product.
ORDER means an order for a Product or Products placed by the Customer in the Store in accordance with these Terms and Conditions.
NEWSLETTER means an electronic service enabling the Customer, upon their express consent, to receive periodic messages containing information about products, promotions, new arrivals, and events related to the Seller. Such messages are sent to the e-mail address provided by the Customer. Detailed terms of using the service are described in these Terms and Conditions.
EUROPEAN UNION (EU) means the member states of the European Union.
NON-EU COUNTRIES means countries outside the European Union.
INTERNATIONAL DELIVERY means delivery of the Product outside the territory of Poland, including to European Union countries and non-EU countries.
§ 3. GENERAL PROVISIONS
All rights to the Online Store, including economic copyrights, intellectual property rights to its name, internet domain, Store Website, and to patterns, forms, and logos posted on the Store Website (except for logos and photographs presented on the Store Website for the purpose of presenting goods, to which copyrights belong to third parties), are vested in the Seller, and use thereof may take place only in the manner specified in and consistent with these Terms and Conditions and with the Seller’s prior written consent.
The Seller shall make every effort to ensure that use of the Online Store is possible for internet users using all popular web browsers, operating systems, device types, and internet connection types.
The Seller uses cookies, which are stored by the Seller’s server on the Customer’s end device during the Customer’s use of the Store Website. Cookies are used to ensure the proper functioning of the Store Website on Customers’ end devices. This mechanism does not damage the Customer’s end device and does not cause configuration changes to Customers’ end devices or the software installed on such devices. Each Customer may disable cookies in the web browser of their end device. The Seller indicates that disabling cookies may, however, cause difficulties in or prevent the use of the Store Website.
In order to place an Order in the Online Store through the Store Website and in order to use the electronic services provided through the Store Website, the Customer must have an active e-mail account.
It is prohibited for the Customer to provide unlawful content and to use the Online Store, the Store Website, or free services provided by the Seller in a manner contrary to law, good practice, or infringing the personal rights of third parties.
The Seller declares that the public nature of the Internet and the use of electronically supplied services may involve the risk of unauthorized persons obtaining and modifying Customers’ data. Therefore, Customers should apply appropriate technical measures to minimize the above-mentioned risks. In particular, they should use antivirus software and tools protecting the identity of Internet users. The Seller shall never ask the Customer to disclose their Password in any form.
It is not permitted to use the resources and functions of the Online Store for the purpose of conducting activities by the Customer that would infringe the Seller’s interests, including advertising another entrepreneur or product, posting content unrelated to the Seller’s business, or posting false or misleading content
§ 4. ORDERS
The Customer may place Orders in the Online Store through the Store Website 7 days a week, 24 hours a day.
The Customer places an Order through the Store Website. A Product is added to the Order by selecting the “ADD TO CART” option under the given Product displayed on the Store Website. After completing the entire Order and indicating in the “CART” the method of Delivery and payment method, the Customer provides the data necessary to complete the Order in accordance with the procedure available on the Store Website and places the Order by submitting the order form to the Seller by selecting the “Buy and Pay” button on the Store Website. Each time before submitting the Order to the Seller, the Customer is informed about the total Price for the selected Product and Delivery, as well as all additional costs that they are obliged to bear in connection with the Sales Agreement.
The information referred to in Article 12(1) of the Act of 30 May 2014 on Consumer Rights shall be sent to the Customer to the e-mail address provided by the Customer when placing the Order.
§ 5. CONCLUSION OF THE SALES AGREEMENT AND ORDER PROCESSING
The Sales Agreement for the Product is concluded upon the Customer placing the Order. After placing the Order, the Customer receives an e-mail with an order summary and information confirming that the Order has been registered in the Store.
The content of Sales Agreements concluded through the Store is stored by the Store’s IT system for a period of at least 3 months from the date of conclusion of each agreement, and the content of such agreements is made available only to the parties to the agreement or, upon request, to authorized public authorities in accordance with applicable law.
The terms of the Sales Agreement are set out in these Terms and Conditions, applicable provisions of law, and any individual arrangements made between the Seller and the Customer.
§ 6. PRICES AND PAYMENTS
6.1. Prices in Poland
Payment for the Product and Delivery Costs may be made by means of:
a. bank transfer to the Seller’s bank account. If the Buyer chooses payment by bank transfer, the transfer should be made within 3 business days. Otherwise, the system will automatically cancel the Order.
b. payment via the electronic payment system available at https://www.przelewy24.pl, provided by Przelewy24 and PayPal.
Payments may only be made by persons authorized to use the given payment instrument. Any cases of fraud detected by the Seller shall be immediately reported to the competent law enforcement authorities.
Prices of Products in the Store are stated in Polish zloty (PLN). The Seller conducts business under a lump-sum taxation scheme and is not obliged to charge VAT.
6.2. Prices for international orders
For orders to European Union (EU) countries:
a. Product prices are stated in Polish zloty (PLN) or euro (EUR), at the Customer’s choice.
b. Prices do not include VAT. The Seller conducts business under a lump-sum taxation scheme and is not obliged to charge VAT.
c. Within the European Union, the free movement of goods applies, which means that there are no customs duties for deliveries within the EU.
d. The Customer shall not incur additional customs charges upon receipt of the shipment.
e. Please note: in some EU countries, local regulations concerning VAT on imported goods may apply. The Customer should consult the local tax authority to obtain information about any potential tax obligations.
For orders to non-EU countries:
a. Product prices are stated in Polish zloty (PLN) or euro (EUR), at the Customer’s choice.
b. Prices do not include VAT (the Seller conducts business under a lump-sum taxation scheme).
c. Prices do not include customs duties, import taxes, customs clearance charges, or any other local taxes applicable in the destination country.
d. The Customer is responsible for paying any customs duties, import taxes, customs clearance charges, and other local taxes that may be imposed by the customs or tax authorities of the destination country.
e. The Seller has no control over the amount of such charges and cannot predict their amount. The Customer should contact the local customs office before placing an Order in order to obtain information about customs duties and taxes.
f. Refusal to pay customs duties or taxes upon delivery may result in additional costs, such as return shipping costs or storage fees, which shall be charged to the Customer or deducted from the refund in the event of withdrawal from the agreement.
g. If the Customer refuses to cover additional customs, tax, or handling charges, the Product will be returned to the Seller and the Customer shall bear the direct cost of returning the Product. If the Product was made to the Customer’s individual measurements (made-to-order, change of Product length or width), its cost shall not be refunded.
Currency conversion:
a. In the case of payment in a currency other than PLN, the currency conversion rate shall be based on the average exchange rate of the National Bank of Poland (NBP) applicable on the date the Order is placed.
b. The final amount payable in a foreign currency shall be provided to the Customer before the Order is finalized.
Compliance with local regulations:
a. The Customer undertakes to comply with all applicable laws of the country to which the ordered Products are shipped, including customs, tax, sanitary, and other local regulations.
b. The Seller shall not be liable for the Customer’s violation of local laws, including incorrect customs declarations, lack of required permits or certificates, or other violations of the laws of the destination country.
§ 7. DELIVERY OF THE ORDERED PRODUCT
7.1. Delivery within Poland
The Seller fulfills Orders by courier shipment through the Delivery Provider.
Products purchased in the Store are shipped via courier or InPost parcel lockers.
The Seller undertakes to deliver the Product free from defects.
Delivery costs, which the Customer bears in addition to the Price of the Product, are indicated on the Store Website when placing the Order.
The Seller posts on the Store Website information about the number of business days required for Delivery and Order processing.
Ordered Products are delivered to the Customer through the Delivery Provider to the address indicated in the order form.
7.2. International delivery
Delivery areas:
a. The Seller provides international deliveries to European Union countries and selected non-EU countries, provided that the buyer’s country accepts online orders of clothing and footwear from the European Union.
b. The current list of countries to which the Seller ships Products is available in the Delivery and Payment section.
c. The Seller reserves the right to refuse delivery to selected countries due to legal, logistical, customs, or other restrictions.
d. The Seller reserves the right to refuse order fulfillment in the following cases:
i. it was not possible to confirm the Order,
ii. the Customer does not comply with these Terms and Conditions,
iii. the Order cannot be fulfilled for logistical reasons, for example customs restrictions or lack of delivery options to a given country,
iv. the Product has sold out,
v. there are clear doubts concerning the Customer, for example suspicion of fraud.
e. The Seller shall promptly notify the Customer electronically to the e-mail address provided in the Order about the refusal to conclude the agreement.
Couriers and delivery times:
a. The Seller cooperates with various courier companies depending on the destination country in order to ensure the best possible delivery service quality.
b. Average delivery times counted from the date of dispatch are:
i. Poland: 1 to 3 business days
ii. European Union: 3 to 7 business days
iii. Non-EU countries: 5 to 10 business days
c. The stated delivery times are average estimated times and are not guaranteed. Actual delivery time may vary depending on the destination country, customs procedures, weather conditions, and other factors beyond the Seller’s control.
d. The Seller shall not be liable for delivery delays resulting from customs procedures, border controls, weather conditions, or other factors beyond the Seller’s control.
Delivery costs:
a. International delivery costs are indicated on the Store Website when placing the Order and depend on the destination country.
b. Remote areas: for certain areas recognized by courier companies as remote areas, additional delivery charges may apply. In such a case, the Seller will contact the Customer before dispatch in order to confirm acceptance of the additional costs.
c. The Customer has the right to refuse acceptance of the additional costs, in which case the Order shall be cancelled and the amount paid shall be refunded to the Customer.
Customs delays and border controls:
a. For orders shipped outside the European Union, shipments are subject to customs procedures and border controls in the destination country.
b. Customs procedures or other import procedures required by the laws applicable in the country of delivery may result in delays beyond the Seller’s control. In the event of a delay, it is recommended to contact the customs office or other competent authority in order to determine the cause of the delay before submitting a complaint to the Seller.
c. Customs authorities of the destination country may provide the Customer with settlement documents regarding additional customs charges after the delivery date. This shall not constitute a delay on the part of the Seller, and the Seller shall bear no liability for the delivery of the above-mentioned settlement documents.
d. The Seller has no control over the duration of customs procedures and shall not be liable for delays resulting from customs inspections, deficiencies in customs documentation provided by the Customer, or other factors related to customs procedures.
e. The Seller shall not be liable for delay or failure to deliver the Order within the time indicated by the Customer as a result of events and circumstances beyond the Seller’s control which prevented Order fulfillment, including customs procedures, border controls, weather conditions, or force majeure.
f. The Customer is obliged to provide all information and documents necessary for customs clearance, where applicable.
Customs declaration:
a. For orders shipped outside the European Union, the Seller is obliged to attach a customs declaration to the shipment.
b. The customs declaration contains information regarding the value of the Products, their description, tariff code, and country of origin.
c. The Seller declares the value of the Products in accordance with the actual price paid by the Customer. The Seller may not undervalue the Products in the customs declaration at the Customer’s request, as this would be contrary to law.
Receipt of shipment:
a. The Customer is obliged to collect the shipment within the period indicated by the courier company.
b. If the shipment is not collected within the required period, it may be returned to the Seller, and the Customer shall be charged the return shipping costs.
c. If the shipment is returned to the Seller due to the Customer’s failure to collect it, the Seller shall refund the Customer the Product Price reduced by the delivery costs and the return shipping costs.
§ 8. RETURN OF THE PURCHASED PRODUCT
8.1. Returns within Poland
Subject to paragraph 4 below, a Customer who is a Consumer may return a Product purchased in the Store without giving any reason by submitting a statement of withdrawal from the Sales Agreement for the Product in accordance with Article 27 of the Act of 30 May 2014 on Consumer Rights. This right may be exercised within 14 days from receiving the Product. Sending the statement before the expiry of the deadline is sufficient to meet the deadline. In the event of withdrawal from the Sales Agreement in the manner indicated in this paragraph, the Customer is obliged to return the Product to the Seller within 14 days from submitting the statement of withdrawal from the Sales Agreement, in accordance with the PRODUCT RETURN PROCEDURE available on the Store Website.
In the event of withdrawal from the Sales Agreement for Products, the Sales Agreement for the Product shall be deemed not concluded.
The right of withdrawal shall not apply to a Consumer in the cases specified in detail in Article 38(1) of the Act of 30 May 2014 on Consumer Rights, including in relation to agreements:
a. for the provision of services, if the entrepreneur has fully performed the service with the Consumer’s express consent, and the Consumer was informed before performance began that after the entrepreneur’s performance had been completed, the Consumer would lose the right of withdrawal;
b. where the subject matter of the performance is a non-prefabricated item manufactured according to the Consumer’s specifications or serving to satisfy their individualized needs;
c. where the subject matter of the performance is an item which, after delivery, due to its nature, becomes inseparably combined with other items.
In the case of personalized Products made to the Customer’s individual measurements, including changes in Product length or width, withdrawal from the agreement is possible only with the Seller’s consent.
If the Customer wishes to withdraw from the agreement for personalized Products, the Customer should send a request for withdrawal by e-mail to CONTACT@PAT-SEGE.COM. The Seller shall consider the request within 14 days of receipt and respond by e-mail.
The Seller shall refund the Customer the amount due for the Product returned by the Customer within 14 days from the date on which the Seller receives the statement of withdrawal from the Sales Agreement for the Products. However, the Seller may withhold the refund of payments received from the Consumer until the Product has been received back or until the Consumer has provided proof of return, whichever occurs first.
In the event of withdrawal from the Agreement, the Seller shall refund the Customer all payments received from the Customer.
If the Consumer exercising the right of withdrawal chose a method of delivery other than the least expensive ordinary delivery method offered by the Seller, the Seller shall not be obliged to reimburse the Consumer for the additional costs incurred by the Consumer.
The Consumer is obliged to return the Product to the Seller without undue delay, but no later than within 14 days from the date on which the Consumer withdrew from the Sales Agreement. It is sufficient to send back the Product to the Seller’s address before the expiry of that period.
All Products must be returned in their original condition, with all original tags attached and in undamaged packaging.
The Customer shall be liable for any reduction in the value of the item resulting from use of it in a manner other than what was necessary to establish the nature, characteristics, and functioning of the item.
The Seller may refuse to accept a return if the returned Product has been altered, in particular if it is incomplete, without tags, used, washed, or damaged, except where the change was necessary to establish the nature, characteristics, and functioning of the item.
The Seller shall make the refund using the same means of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of refund which does not involve any costs for the Consumer.
8.2. Returns from abroad (EU and non-EU)
Right of withdrawal for customers from the European Union:
a. Customers from European Union countries who are Consumers have the right to withdraw from the agreement within 14 days of receiving the Product, in accordance with Directive 2011/83/EU on consumer rights and the Polish Act of 30 May 2014 on Consumer Rights.
b. The withdrawal procedure is the same as for customers from Poland (§ 8.1).
Right of withdrawal for customers from non-EU countries:
a. Customers from non-EU countries who are Consumers have the right to withdraw from the agreement within 14 days of receiving the Product, in accordance with the Polish Act of 30 May 2014 on Consumer Rights.
b. The withdrawal procedure is the same as for customers from Poland (§ 8.1).
Cost of returning the Product:
a. The Customer shall bear the cost of returning the Product to the Seller, unless the Product is defective.
Customs duties and taxes on returns for non-EU countries:
a. For returns from non-EU countries, the Customer may be required to pay customs duties and taxes upon return of the shipment if the return instructions were not properly followed or if customs authorities impose such charges.
b. The Seller does not reimburse the Customer for customs duties and taxes paid by the Customer upon receipt of the original shipment.
c. If the Seller is charged customs or tax costs upon return of the shipment, such costs shall be deducted from the amount refunded to the Customer.
Return procedure from abroad:
a. The Customer must contact the Seller before returning the Product by sending an e-mail to CONTACT@PAT-SEGE.COM with information about the intention to make a return.
b. The Seller shall provide the Customer with return instructions, including the return address and required documents, for example a customs declaration for returns from outside the EU.
c. The Product must be returned in its original packaging, unused, and with tags attached.
d. The Seller shall refund the amount due within 14 days from receipt of the returned Product, reduced by the return costs, where applicable.
No return option for certain countries:
a. Due to the high cost of international returns and customs procedures, the Seller reserves the right to refuse to accept returns from selected non-EU countries.
b. In such a case, the Seller shall inform the Customer of the lack of return possibility before the Order is finalized.
§ 9. PRODUCT COMPLAINTS
Any complaints relating to the Product or the performance of the Sales Agreement may be submitted by the Customer in writing to: CONTACT@PAT-SEGE.COM.
A complaint submission should include in particular the following data: the Customer’s full name, address, order number, transaction date, and the subject matter and reason for the complaint.
A complaint regarding a Product shall be considered within 14 days from the date the complaint is submitted. The Customer shall be notified by e-mail of the manner in which the complaint has been resolved.
Complaints shall be submitted in the manner and under the rules described in detail in the STORE’S COMPLAINT PROCEDURE available on the Store Website.
§ 10. NEWSLETTER
The Customer may voluntarily subscribe to the Newsletter, which provides current information about the offer, promotions, new products, and activities of the Seller and its brand. Content sent as part of the Newsletter may include marketing and commercial materials.
In order to use this service, the Customer must enter a valid e-mail address in the relevant form on the online store website and tick the appropriate box during registration or when placing an Order.
Providing an e-mail address is necessary for the provision of the Newsletter service.
The service is provided free of charge and may be activated only after the Customer has subscribed.
The Newsletter is sent periodically for an indefinite period until the Customer unsubscribes or the Seller discontinues the service.
The Customer may unsubscribe from the Newsletter at any time by clicking the unsubscribe link included in the e-mail message or by sending such a request to the Seller.
The Seller reserves the right to discontinue the Newsletter service at any time, subject to prior notice to subscribers.
§ 11. PERSONAL DATA PROTECTION
GDPR means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
Personal data are processed for the purpose of order fulfillment on the basis of Article 6(1)(b) GDPR and are obtained voluntarily from Customers.
Providing data is voluntary, but necessary for order fulfillment. Without providing the data, the Sales Agreement cannot be concluded.
The controller of personal data is Patrycja Segedyn, conducting business under the name PAT SEGE, with its registered office at ul. Górnicza 1a, 59-800 Lubań, Poland, Tax Identification Number (NIP): 8982303969, REGON: 527752611. Personal data shall be stored for an indefinite period.
Everyone has the right to request access to their personal data, rectification, erasure, or restriction of processing, as well as the right to object to processing and the right to data portability.
The Customer has the right to lodge a complaint with the supervisory authority, namely the President of the Personal Data Protection Office in Poland.
The Seller undertakes to maintain confidentiality in relation to Customer data and not to disclose such personal data to unauthorized persons, and to duly protect such information against access by any unauthorized persons.
The Customer’s personal data shall be processed for one or more of the following purposes:
a. in order to carry out actions requested by the Customer before entering into the agreement,
b. in order to conclude and perform the agreement entered into by the Customer with the Seller,
c. in order to fulfill the legal obligations incumbent on the Seller,
d. in order to pursue the Seller’s legitimate interests.
Transfer of personal data outside the European Union:
a. In the case of international orders, the Customer’s personal data may be transferred to courier companies and customs authorities in the destination country for the purpose of delivery and customs procedures.
b. The Seller ensures that the transfer of personal data outside the European Union is carried out in compliance with GDPR and with the application of appropriate safeguards, for example standard contractual clauses approved by the European Commission.
§ 12. FINAL PROVISIONS
The Seller shall be liable for non-performance or improper performance of the agreement. However, in the case of agreements concluded with Customers who are Entrepreneurs, the Seller shall be liable only in the event of intentional damage and only within the limits of actual losses incurred by the Customer who is an Entrepreneur.
The content of these Terms and Conditions may be recorded by printing, saving on a data carrier, or downloading at any time from the Store Website.
Governing law and dispute resolution:
a. For customers from Poland: the law applicable to the resolution of any disputes arising under these Terms and Conditions shall be Polish law. In the event of a dispute arising from the concluded Sales Agreement, the parties shall seek to resolve the matter amicably. The court having jurisdiction shall be the court competent for the Seller’s registered office in Lubań.
b. For customers from the European Union: the law applicable to the resolution of any disputes shall be Polish law, subject to the mandatory provisions of the law of the Consumer’s country of residence. A Consumer from the European Union has the right to use out-of-court methods of complaint handling and redress, including the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr.
c. For customers from non-EU countries: the law applicable to the resolution of any disputes shall be Polish law. The court having jurisdiction shall be the court competent for the Seller’s registered office in Lubań.
Language of the agreement:
a. The Sales Agreement is concluded in Polish.
b. For foreign customers, the Seller provides an English translation of these Terms and Conditions for information purposes only. In the event of any discrepancy between the Polish version and the English version, the Polish version shall prevail.
In all matters not regulated by these Terms and Conditions, the following shall apply:
a. the Act of 30 May 2014 on Consumer Rights,
b. the Act of 18 July 2002 on the Provision of Electronic Services,
c. the Polish Civil Code,
d. Regulation (EU) 2016/679 (GDPR),
e. and other applicable provisions of Polish law and European Union law.
The provisions of these Terms and Conditions do not infringe consumer rights resulting from non-conformity of the goods with the agreement. The provisions of these Terms and Conditions shall be interpreted in a manner ensuring their compliance with applicable law.
